You count on your property insurer to pay when a fire or flood damages your home or building. Whatever the claim, we’re here to make sure they honour that promise.

When your home or commercial property…

is damaged it is already stressful, but that stress is magnified a dozenfold when your insurance company then refuses to pay to fix the problem.

You discovered damage to your property. It might have been damaged by a burst water pipe, a kitchen fire, a leaky oil tank, or heavy snow on your roof. You contacted your insurer promptly and made a claim for coverage to fix the problem.  After conducting a short investigation, your insurer chooses to deny your claim, leaving you to pay the bill. 

Insurers have to explain their reasons for refusing to pay you. Property insurers often try to avoid insurance claims for two reasons : 

  1. The insurer says the claim is outside the scope of your insurance policy, or that the cause of your property damage is specifically excluded; or
  2. The insurer says you breached your duties under the insurance policy, either by how you were using the property or because you didn’t share details about the property itself which would make it more ‘risky’ for a claim. 

The insurer’s investigation of your claim may not be as thorough as it should be. Even if they get all the right facts and figures, insurance staff may not be trained to understand the full meaning of your policy. Meantime, insurers are always looking for loopholes or exclusions to avoid the responsibility to pay you for the coverage they sold you. 

Even if it turns out that the insurer has justification to deny you coverage, you may still have a good legal claim. Often, people buy their insurance with the help of a broker. Those professionals get paid to ask you the right questions in order to sell you the proper coverage. Sometimes, brokers make mistakes and leave you paying the price.

Your insurance company won’t conclude on its own that you have unjustly or unreasonably been denied coverage. Your broker won’t admit they failed to help you buy the right policy. You need help to make that happen.
